1. Introduction

Welcome to EnergetiCreations (“we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your access to and use of:

• Energeticreations.co.uk      and any sub‑domains (collectively, the “Site”);
• our      digital artwork files, downloads and related services (the “Services”).

By purchasing, downloading, accessing or using any portion of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not accept every part of the Terms, do not use the Services.

2. Eligibility & Account Registration

1. You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases.
2. When you create an account, you agree to provide accurate, complete information      and to keep it updated.
3. You  are responsible for safeguarding your login credentials. Any activity under your account is deemed yours unless and until you notify us of unauthorised use.

3. Digital Products, Orders & Payments

1. Nature of goods. All products are digital files delivered electronically—no physical items will be shipped.
2. Pricing.  Prices are listed in GBP and include applicable VAT unless stated      otherwise. We reserve the right to change prices at any time before you      place an order.
3. Payment processing. We use third‑party payment processors. By submitting      payment information, you authorise the processor to debit the total due. We may cancel or refuse any order if payment is not successfully completed or suspected fraud occurs.
4. Download availability. After successful payment you will receive a link to      download the purchased files. Ensure you have adequate software/hardware to open them.

4. Refunds & Cancellations

Because our products are intangible digital goods, all sales are final once the download starts. Under UK law (Consumer Contracts Regulations 2013), the 14‑day “cool‑off” period ends when the digital content download begins with your consent. If you cannot access a file or it is corrupted, contact us within 14 days; we will attempt to replace the file or, in our sole discretion, issue a refund.

5. Licence & Intellectual Property

1. Ownership.     All artwork, text, graphics, software and other content on the Site      (“Content”) is owned by EnergetiCreations or our licensors and is      protected by UK and international copyright law.
2. Your licence. Upon purchase we grant you a non‑exclusive, non‑transferable,      worldwide licence to download and use the digital artwork for personal      or commercial end‑products subject to these restrictions:

You MAY

• Display the artwork in digital or printed form.

• Incorporate it into physical goods for sale up to 1 000 units. 

• Modify colours, size or composition. 

You MAY NOT

 • Resell, share, re‑distribute or make the raw files publicly available. 

• Claim the artwork as your own copyright. 

• Use in logos or trademarks without an extended licence. 

• Use in any defamatory, hateful or unlawful manner. 

Attribution.     Credit is appreciated but not required for standard licences; it is  required for editorial/blog use.

Extended      licences. For uses exceeding 1 000      units, contact us for a custom licence.

6. User Conduct

You agree not to:

• Violate any applicable law or regulation.
• Post or transmit content that is unlawful, harassing, hateful, defamatory, obscene or otherwise objectionable.
• Upload  viruses, malware or code intended to harm the Site or other users.
• Attempt to gain unauthorised access to any part of the Site or our systems.
• Use automated means (bots, scrapers) to access the Site without our prior      written consent.
• Spam, advertise or solicit without permission.

7. Suspension & Termination

We may suspend or terminate your account and access to the Services, with or without notice, if:

• you breach these Terms;
• we are required by law;
• we discontinue the Services; or
• we detect fraudulent, abusive or harmful activity.

On termination, licences already granted remain subject to the restrictions in § 5.

8. Availability, Accuracy & Disclaimer

1. Service interruptions. We aim for continuous availability but do not guarantee      the Site will be uninterrupted or error‑free. Maintenance or technical      issues may occur.
2. Information accuracy. We strive to present accurate information but make no      warranties that content on the Site is complete, current or error‑free.
3. “As‑is” basis. The Services are provided “as is” without warranties of any      kind, express or implied, including merchantability, fitness for a      particular purpose and non‑infringement. Your use is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by law, EnergetiCreations, its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising out of or in connection with your use of the Services—even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim shall not exceed the amount you paid us for the product giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless EnergetiCreations and its affiliates from and against all claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services.

11. Changes to These Terms

We may revise these Terms at any time. Substantial changes will be posted on this page and, if you have an account, we will notify you by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales. You and EnergetiCreations agree to submit to the exclusive jurisdiction of the courts of England and Wales. Before filing suit, the parties will attempt to resolve any dispute informally for at least 30 days.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force.
